At Fair Furniture B.V. we respect your privacy. We therefore exclusively process the data we need for (the improvement of) our services and carefully handle the information we have about you and your use of our services. The collected data will never be shared with third parties for commercial ends.

This Privacy Policy applies to the use of the website and the affiliated services of Fair Furniture B.V. The terms and conditions are valid from 24/05/2018 onwards. Publication of a new version cancels out the validity of previous versions. This Privacy Policy outlines which information about you we may gather, how we may use this information and with whom and under which conditions it might be shared with third parties. It also explains how we store your data, how we protect them against misuse and what your rights are regarding the information you provided us with.

About the data processing

Below we explain how we process your data, where we store them, which security measures we use and who might be able to view your data.

Web shop software

Our web shop is developed with Lightspeed software. Personal data that you make available to us for the benefit of our services will be shared with this party. Lightspeed has access to your personal data in order to provide us with (technical) support. They will never use these data for anything else. Lightspeed is obliged to take appropriate security measures on the grounds of the agreement. These security measures consist of the implementation of SSL encryption, a strong password policy, and a secure data storage. Lightspeed reserves the right to share the collected data within its own group and affiliated partners in order to further improve the service. Lightspeed takes into account the applicable statutory retention periods for (personal) data.

Webhosting and e-mail

For our webhosting and email services we have opted to make use of the services of TransIP. TransIP processes personal data on our behalf and does not use your data for its own purposes. However, this party can collect metadata about the use of the services. These are not personal data. TransIP has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. TransIP is obliged to observe secrecy on the grounds of the confidentiality agreement.

Mailchimp

Our website uses Mailchimp, a third party that handles the e-mail traffic from our website as well as sending of our newsletters. All confirmation e-mails your receive from our website and web forms are sent via Mailchimp’s servers. Mailchimp will never use your name and e-mail address for its own purposes. Below every e-mail automatically sent through our website you will find an unsubscribe link. Once you unsubscribe through that link, you will no longer receive our newsletter. This can reduce the functionality of our website! Your personal data will be securely stored by Mailchimp. Mailchimp makes use of cookies and other technologies that provide insight into whether emails are being opened and read. Mailchimp maintains the right to use your data in order to further improve its services and share information with others to that end.

Payment processor

BUCKAROO

We use the Buckaroo platform for handling (a part of) the payments in our web shop. Buckaroo processes your name, address and payment details such as your bank account or credit card number. Buckaroo took all the relevant technical and organizational measures to protect your data. Buckaroo maintains the right to use your data in order to improve its services and share (anonymous) details with third parties to this end. Buckaroo will, in the case of an application for a deferred payment (credit facility), share personal information and information regarding your financial position with credit rating agencies. All the aforementioned guarantees with the regard to the protection of your personal details also applies to the section of Buckaroo’s services for which they engage third parties. Buckaroo does not store your details any longer than is legally allowed.

Reviews

TRUSTED SHOPS

We collect reviews via the Trusted Shops platform. When writing a review through Trusted Shops you are obliged to provide your name, address and e-mail address. Trusted Shops shares this information with us so that we can link the review to your order. Trusted Shops also publishes your name and address on its own website. In some cases Trusted Shops may contact you in order to provide an explanation of your review. When we invite you to leave a review, we share your name and e-mail address with Trusted Shops. They only use this information for the purpose of inviting you to write a review. Trusted Shops has taken the appropriate technical and organizational measures to protect your personal data. Trusted Shops reserves the right to engage third parties for the provision of services, for which we have given permission to Trusted Shops. All the aforementioned guarantees with the regard to the protection of your personal details also applies to the section of Trusted Shop’s services for which they engage third parties.

Integration of the Trusted Shops Trustbadge

We have integrated the Trusted Shops Trustbadge on this website in order to display our Trusted Shops Trustmark and offer the Trusted Shops products to customers after placing an order.

This serves the protections of our legitimate interests in the optimal marketing of our offer. The Trustbadge and the advertised trust badge services are offered by TRUSTED SHOPS GmbH, Subbelrather Str. 15C, 50823 Cologne, Germany. With every use of the Trustbadge, the web server automatically saves a so-called server log file which contains e.g. your IP address, the date and time of the request, the volume of the data transferred and the requesting provider (access data), and documents requested. Those access data are not analysed and are automatically overwritten no later than seven days after the end of your website visit. Other personal data are transferred to Trusted Shops only if you decide to use or have already registered to use Trusted Shops products after placing an order. In such case, the contract concluded between you and Trusted Shops applies.

Shipping and logistics

Cheapcargo & Vlot verhuizingen

Once you place an order with us, it is our job to have your parcel delivered to you. We use the sevices of Cheapcargo & Vlot verhuizingen to carry out the deliveries. To that end, we need to share your name and address details with Cheapcargo & Vlot verhuizingen. Cheapcargo & Vlot verhuizingen will only use these details in order to execute the agreement. In the event that Cheapcargo & Vlot verhuizingen engage subcontractors, they will also make your data available to these parties.

Billing and accounting

Administration Office

We use the services of an Administration Office to keep our records and accounts up-to-date. We share your name, address and residence details and details regarding your order. This data is used for the administration of sales invoices and other accounting matters. Your personal data is sent and stored protected. The Administration Office is obliged to observe secrecy and will treat your information confidentially. The Administration Office does not use your personal data for purposes other than those described above.

External sales channels

VTwonen and Bol.com

We sell (a part of) our products through the platforms VTwonen and Bol.com. If you place an order via these platforms, VTwonen and Bol.com will share your order details and personal details with us. We use this data to process your order. We will treat your information confidentially and have taken the appropriate technical and organisational measures to protect your data against loss and unauthorized use.

Aim of the data processing  

General aim of the processing

We exclusively use your data for the purpose of our services. Meaning that the aim of the processing is directly related to the order you supply. We do not use your data for (targeted) marketing. If you share your data with us and we use them to – without your request to do so – contact you later, we will explicitly ask for your permission. We will not share your data with any third parties other than those we need to fulfill administrative obligations. The latter are bound to secrecy by either our agreement with them or by legal obligation.

Automatically collected data

Data automatically collected by our website will be processed with the aim to further improve our services. These details (such as your IP address, web browser and operating system) are not personal details.

Cooperation with fiscal or criminal investigation  

Fair Furniture B.V. might be legally bound to share your detail in the case of fiscal, criminal or government investigation. In this case we are forced to share your details, but will resist with all the means available within a legal framework.

Data storage terms

We will store your personal data as long as you are a customer with us. This means we will save your customer profile until you notify us that you no longer wish to make us of our services. Once you inform us about this, we will also consider it as a request to remove your data. Based on applicable administrative obligations we need to save invoices with personal data. We save these until the applicable term expires. Employees, however, do no longer have access to your customer profile and the documents we created after you have placed your order with us.

Your rights

On the basis of applicable Dutch and European legislation, you can have certain rights pertaining to the personal data that are being processed by us on our behalf. We explain below which rights these are and how you can invoke these rights.

In order to avoid misuse we, in principle, only send transcripts and copies of your details to your email address as known to us. In case you would like to receive your details at a different email address or by post, we will ask you to identify yourself. We keep an administration of completed requests, in case of a request to be removed we will file anonymised details. You will receive all transcripts and copies in the machine readable format that we use within our systems.

You have the right to file a complaint with the Dutch Data Protection Authority in case you suspect we misuse your personal data.

Right of inspection

You always have the right to inspect the details related to your person or traceable as such, that we process or have processed by others. You can file a request to that extent using the contact details below this document. You will receive a reaction within 30 days. Once your request is granted, we will send (to the email address known to us) a copy of all your details and an overview of all the third parties that processed them, citing the category under which we have saved them.

Right to rectification

You always have the right to have inaccurate details, related to your person or traceable as such, rectified. You can file a request to that extent using the contact details below this document. You will receive a reaction within 30 days. Once your request is granted, we will send (to the email address known to us) a confirmation that your details have been rectified.

Right to restriction of processing

You always have the right to have the processing of details, related to your person or traceable as such, restricted. You can file a request to that extent using the contact details below this document. You will receive a reaction within 30 days. Once your request is granted, we will send (to the email address known to us) a confirmation that your data (until you cancel the restriction) will no longer be processed.

Right to transfer  

You always have the right to have the details, related to your person or traceable as such, processed by another party. You can file a request to that extent using the contact details below this document. You will receive a reaction within 30 days. Once your request is granted, we will send (to the email address known to us) a copy of all your details we, or other parties on our behalf, have processed. It is most likely that we can no longer continue the service afterwards as secure linking of the data can no longer be guaranteed.

Right to object and other rights

If you do not agree with the way in which Fair Furniture B.V. or third parties process your personal data, you have the right to object. Once you object, we will put the processing of your data on hold awaiting the handling of your objection. In case your objection is well-founded we will provide you with all the transcripts and copies of the details that we or third parties have processed and will cease all further processing. Furthermore, you have the right not to be subjected to automated individual decision making or profiling. We do, however, process your data in such a way that this right does not apply.
